    MEMBERSHIP TERMS AND CONDITIONS

    FOR OUR CLASSES

    Welcome to Addictive Pole Fitness!

    In these terms, we also refer to Cali B Pty Ltd (ACN 637 851 211) ATF the Cali B Trust ABN: 14 778 990 432 operating under the registered business name Addictive Pole Fitness as “Addictive Pole Fitness”, “our”, “we”, or “us”.

    What are these terms about?

    These terms apply when you sign up for our pole fitness classes and facilities through our website, being www.addictivepolefitness.com/, our Addictive Pole Fitness App and any other websites we operate with the same domain name and a different extension including our affiliated MindBody website located at https://clients.mindbodyonline.com/ASP/main_shop.asp (Website).

    Key Words used in these terms

    To make it easier for you to understand the terms on which we provide, and you use, the Pole Fitness Classes, we’ve tried to keep these terms of use (terms) as simple as possible by using plain English.

    When we say “Pole Fitness Classes” in these terms, we mean our pole fitness classes and our ancillary services including access to our facilities, studio hire, pole parties, open practice and level assessments (together, the Services).

    We’ve also used a few other capitalised words and phrases as shorthand to refer to recurring concepts. Each of these are defined in bold and in brackets after the concepts are first mentioned.

    Acceptance of these terms

    Before you enrol in our Pole Fitness Classes, or otherwise engage with the Pole Fitness Classes, please carefully read these terms. If you don’t agree to these terms, please don’t enrol in the Pole Fitness Classes. By clicking “accept” when you create an account, or otherwise proceed to engage with the Pole Fitness Classes, you agree to be bound by these terms.

    Disclaimer

    Participating in the Activities is potentially dangerous and may expose you to risks, including accidents, serious injury, illness or even death. Addictive Pole Fitness uses its best endeavours to protect you but there remains a possibility of an accident causing injury, illness, disability, death or property damage to you. You participate in the Activities at your own risk and acknowledge that you have read clause 16, which describes how Addictive Pole Fitness limits its liability to you.

    1 OUR POLE FITNESS CLASSES

    Addictive Pole Fitness provides in-studio pole fitness classes, along with online pole fitness exercise workout videos. You may attend an in-studio pole fitness class by first making a Booking (defined in clause 3.1) via our Website. Any Pole Fitness Classes that are provided in a pre-recorded video format or livestream webinar, are to only be viewed online through your Account (defined in clause 3.1) and not downloaded, reproduced or republished by you in any way.

    2 POLE FITNESS GUIDELINES

    We may provide pole fitness guidelines and workouts on our Website from time to time (Guidelines), which are intended to provide you with guidance on pole fitness workouts. The Guidelines are intended to be a guide only with general information and are not a substitute for medical advice. Ultimately, you are responsible for knowing your body and your limits. If you are unsure about the Guidelines, or any part of our Services, you must seek medical advice.

    3 BOOKING POLE FITNESS CLASSES

    3.1 BOOKING

    (a) To book a Pole Fitness Class, you will need to create an account on the Pole Fitness App (Account), pay the Fees (as defined in clause 4(a)(i)) for your elected Services and book an available time slot for the Pole Fitness Class (together, a Booking).

    (b) You are solely responsible for managing your Booking using the Addictive Pole Fitness App or any other booking system nominated by Addictive Pole Fitness from time to time.

    (c) Available time slots for a Pole Fitness Class close 2 hours prior to the commencement of that class.

    (d) Series classes (levels, multi-week workshops or accessories):

    (i) are available for booking until two weeks after the first class of the series; and

    (ii) must be booked using the Addictive Pole Fitness App, using the "Book Multiple" function. Refer to booking instructions here https://www.addictivepolefitness.com/howtobook. A failure to use the Book Multiple in a timely manner will result in the member not being enrolled into all classes relevant to a series.

    (e) Drop-In, Zoom, and Open Practice bookings:

    (i) are available for booking from 6:00 am for the upcoming week of the relevant class;

    (ii) must be booked via the Addictive Pole Fitness App.

    3.2 ELIGIBILITY

    This Website is not intended for unsupervised use by any person under the age of 18 years old or any person who has previously been suspended or prohibited from using the Website. By using the Website, you represent and warrant that you are either:

    (a) over the age of 18 years and accessing the Website for personal use; or

    (b) accessing the Website on behalf of someone under the age of 18 years old, where you:

    (i) accept these terms on that person’s behalf; and

    (ii) consent to that person's use of the Services and the Website.

    3.3 ACCOUNTS

    (a) By creating an Account, making a Booking, or by otherwise accessing the Pole Fitness Classes, you represent and warrant that:

    (i) you have the legal capacity and are of sufficient age to enter into a binding contract with us (or someone of sufficient age and capacity is contracting on your behalf); and

    (ii) you are authorised to use the bank account, debit or credit card you provide for your Booking.

    (b) You are responsible for managing your Account and ensuring that you only access and engage with the Pole Fitness Classes in an appropriate manner.

    (c) You are granted a limited licence to access the Pole Fitness Classes for your own personal, non-commercial purposes.

    (d) We will only revoke your licence and terminate your Account if we suspect, for any reason, in our sole discretion, that you are:

    (i) misusing the licence, for example by distributing the Pole Fitness Classes to other people or giving access to your Account to other people, you are making commercial use of or infringing our Intellectual Property Rights (defined in clause 6.2) in the Pole Fitness Classes, or if you do not comply with these terms;

    (ii) behaving in a manner that Addiction Pole Fitness considers to be inappropriate or disruptive to staff and members attending Pole Fitness Classes;

    (iii) in default or breach of these terms;

    (iv) convicted of a criminal offence involving fraud or dishonesty or an offence which, in the opinion of the other party, affects Addictive Pole Fitness’ obligations under these terms; or

    (v) behaving in a way tending to bring you or Addictive Pole Fitness into disrepute.

    (e) In the event your license is revoked by application of Clause 3.3(d), and your Account is terminated, you will not be entitled to a refund of the Fees.

    3.4 ACCEPTANCE OF THESE TERMS

    (a) Booking Pole Fitness Classes constitutes your acceptance to enter into a contract with us under these terms, where we will provide you with the Pole Fitness Classes you have ordered in exchange for your payment of the total Fees listed upon checkout.

    (b) These terms are not agreed between you and us until we have approved your payment of the Fees and you receive an email from us confirming your Booking.

    4 PAYMENT

    4.1 GENERAL PAYMENT TERMS

    (a) For the purpose of this Agreement, “Fees” are:

    (i) all fees as displayed and accepted by you at the time of checkout via our payment system accessed through our Website;

    (ii) in Australian Dollars; and

    (iii) subject to change without notice prior to your booking

    (b) (Upfront Payment obligations) You must pay the Fees, in full, at the time of your Booking if you elect to purchase a Pay In Full Membership (defined in Clause 4.4) or a Class Pass Membership (defined in clause 4.5).

    (c) (direct debit payment obligations) You must pay the Fees on the Monday of each week, in advance of the first Pole Fitness Class you attend, if you elect to purchase a Recurring Membership (defined in clause 4.3).

    (d) (additional direct debit payment obligations) if you elect to purchase a Recurring Membership, you also:

    (i) agree to enter into a service agreement with our Payment Providers (defined in 4.1(g));

    (ii) authorise Addictive Pole Fitness to charge the your bank account in advance in line with the service agreement with our Payment Providers;

    (iii) must ensure that there are sufficient funds available in your account to allow our Payment Providers to debit the Fees payable;

    (iv) must give Addictive Pole Fitness written notice of at least 48 hours if:

    (A) you are transferring or closing the account specified in your service agreement with our Payment Provider;

    (B) there are any changes to your credit card details specified in your service agreement with our Payment Provider; and

    (v) acknowledge and agrees that if a debit is returned by your nominated financial institution as ‘unpaid’, Addictive Pole fitness reserves the right to suspend your access to the Services until the amounts payable are received by Addictive Pole Fitness.

    (e) (GST) Unless otherwise indicated, amounts stated on the Website include GST. In relation to any GST payable for a taxable supply by us, you must pay the GST subject to us providing a tax invoice to you.

    (f) (Card surcharges) We reserve the right to charge credit card surcharges in the event that payment of the Fees are made using a credit, debit or charge card (including Visa, MasterCard or American Express).

    (g) (Online payment partner) We may use third-party payment providers (Payment Providers) to collect payment of the Fees for Pole Fitness Classes. The processing of payments by the Payment Provider will be, in addition to these terms, subject to the terms, conditions and privacy policies of the Payment Provider and we are not liable for the security or performance of the Payment Provider. We reserve the right to correct, or to instruct our Payment Provider to correct, any errors or mistakes in collecting your Fees.

    (h) (Pricing errors) In the event that we discover an error or inaccuracy in the Fees for your Booking, we will attempt to contact you and inform you of this as soon as possible. You will then have the option of enrolling in the Pole Fitness Classes at the correct Fees or cancelling your Booking. If you choose to cancel your Booking and the Fees have already been debited, the full amount will be credited back to your original method of payment.

    4.2 FAILED PAYMENTS

    (a) If a direct debit payment fails, Addictive Pole Fitness will undertake the following procedure:

    (i) MindBody will send an automated email advising the member of the failed payment (if the member has activated email or text notification);

    (ii) Fee payments will be processed again after 2pm the same day and, if unsuccessful, again on the next business day; and

    (iii) Addictive Pole Fitness may attempt to contact the member via text, email or phone.

    (b) A dishonour fee will be charged by Addictive Pole Fitness when reprocessing a failed payment in the amount outlined in https://www.addictivepolefitness.com/pricing.

    (c) Our Payment Providers may also charge a dishonour fee for reprocessing a failed payment, Addictive Pole Fitness accepts no responsibility for the administration and processing of this fee.

    (d) If you have any direct debit payment obligations during a Recurring Membership Term (as defined in clause 4.3(b) below), and you have incurred more than five (5) failed payments of Fees in one Recurring Membership Term, we will cancel your nominated direct debit option at the end of that term, and you will not be not permitted to use the Direct Debit option for the next Recurring Membership Term.

    (e) If you have any direct debit payment obligations during a Recurring Membership Term (as defined in clause 4.3(b) below), and you have 3 weeks of unpaid payments Fees outstanding, we will immediately cancel your nominated direct debit option at the end of that term, and you will not be not permitted to use the Direct Debit option for the next Recurring Membership Term.

    4.3 RECURRING MEMBERSHIPS

    In the event that you elect to purchase a recurring membership via our Website (Recurring Membership), the following terms will apply:

    (a) A Recurring Membership includes:

    (i) The number of classes available at your membership level as outlined on our payment system on our Website or by our Payment Providers at the time of your Booking;

    (ii) Open practice allocation; and

    (iii) Online membership access.

    (b) A Recurring Membership has a term for a period commencing on the later of:

    (i) the date nominated on the Website for the commencement of the 10-week term that you first select to purchase for your Recurring Membership; or

    (ii) the date you make a Booking for a Recurring Membership

    and will continue until the date nominated on the Website as the conclusion of that 10-week term

    (collectively the Recurring Membership Term).

    (c) A Recurring Membership Term will continue to renew for an additional 10 week period, unless otherwise cancelled in accordance with this clause 4.3.

    (d) The purchase of a Recurring Membership is non-refundable from the day of Booking.

    (e) You may terminate a Recurring Membership at the conclusion of an active Recurring Membership Term by submitting to Addictive Pole Fitness, a completed membership termination form prescribed by us, prior to the commencement of a renewed 10-week Recurring Membership Term.

    (f) If you terminate a Recurring Membership within 4 days of the conclusion of a Recurring Membership Term, you will automatically be charged a $40 late termination fee.

    (g) You will be charged the full rate of Fees for a Recurring Membership Term if you cancel after the commencement of a renewed 10-week Recurring Membership Term and you will not be entitled to a refund.

    (h) You may upgrade your Recurring Membership during a Recurring Membership Term, by a completed membership upgrade form prescribed by us.

    (i) You may downgrade a Recurring Membership at the conclusion of an active Recurring Membership Term by submitting to Addictive Pole Fitness, a completed membership downgrade form prescribed by us, prior to the commencement of a renewed 10-week Recurring Membership Term.

    4.4 PAY IN FULL MEMBERSHIPS

    In the event that you elect to purchase a membership that is pre-paid for a full term via our Website (Pay In Full Membership), the following terms will apply:

    (a) A Pay In Full Membership includes:

    (i) The number of classes available at your membership level as outlined on our payment system on our Website or by our Payment Providers at the time of your Booking;

    (ii) Open practice allocation; and

    (iii) Online membership access.

    (b) A Pay In Full Membership term has a period commencing on the later of:

    (i) the date nominated on the Website for the commencement of a 10-week term that you first select to purchase for your Pay In Full Membership; or

    (ii) the date you make a Booking for your Pay In Full Membership

    and will continue until the date nominated on the Website as the conclusion of that 10-week term

    (collectively the Pay In Full Term).

    (c) The purchase of a Pay In Full Membership is non-refundable from the first day of the Pay In Full Term.

    (d) Pay In Full Terms expire at the end of each term and you will need to purchase a new Pay In Full Membership by the end of the Pay In Full Term to continue as an active member.

    (e) Addictive Pole Fitness will assume the member has cancelled a Pay In Full Membership if no membership is purchased by the end of the Pay In Full Term.

    4.5 RECURRING/ PAY IN FULL MEMBERSHIP CLASS PASSES

    In the event that you elect to purchase a membership via our Website (Class Pass), the following terms will apply:

    (a) A Class Pass includes:

    (i) The number of classes available at your membership level as outlined on our payment system on our Website or by our Payment Providers at the time of your Booking;

    (ii) Open practice allocation; and

    (iii) Online membership access.

    (b) All Class Passes have a seven (7) day term (Class Pass Term), commencing on the Monday of the week that you first make a Booking for the Class Pass.

    (c) Class Pass Terms expire seven (7) days after the Monday of the week you make a Class Pass Booking.

    (d) Addictive Pole Fitness may extend the term of a Class Pass at their absolute discretion.

    4.6 CLASS PASSES

    In the event that you elect to purchase a one-off class pass via our Website (Class Pass), the following terms will apply:

    (a) A Class Pass includes:

    (i) The number of classes available at your membership level as outlined on our payment system on our Website or by our Payment Providers at the time of your Booking;

    (ii) Open practice allocation; and

    (iii) Online membership access.

    (b) All Class Passes have a specified term (Class Pass Term), commencing on the day of purchasing the Class Pass.

    (c) Addictive Pole Fitness may extend the term of a Class Pass at their absolute discretion.

    5 COLLECTION NOTICE AND PRIVACY

    (a) We may collect personal information about you in the course of providing you with our Pole Fitness Classes, to contact and communicate with you, to respond to your enquiries and for other purposes set out in our Privacy Policy.

    (b) Our Privacy Policy contains more information about how we use, disclose and store your information and details how you can access and correct your personal information.

    (c) We may collect sensitive information about you, or your child, during the course of providing you with Services. We only collect information that you choose to provide us and will not collect this without your consent. It is up to you whether you choose to disclose your sensitive information.

    (d) We may need to share sensitive information about you, or your child, in a medical emergency in cases where we may not be able to obtain your consent.

    (e) We may need to share your information with third party platforms that we use to provide you with the Services, such as Mindbody. You can view their privacy policy here.

    (f) By agreeing to these terms, you agree to be bound by the clauses outlined in our Privacy Policy.

    6 INTELLECTUAL PROPERTY

    6.1 OUR IP

    Intellectual Property Rights in the Pole Fitness Classes and our Services and any other related information or materials (materials) are owned or licensed by us. Except as permitted under applicable laws, no part of the material can be reproduced, adapted, distributed, displayed, transmitted or otherwise exploited for any commercial purposes without our express written consent.

    You will not under these terms acquire Intellectual Property Rights in any of Our IP.

    6.2 DEFINITIONS

    For the purposes of this clause 6:

    (a) “Our IP” means all materials owned or licensed by us and any Intellectual Property Rights attaching to those materials.

    (b) “Intellectual Property Rights” means any and all present and future intellectual and industrial property rights throughout the world (whether registered or unregistered), including copyright, trade marks, designs, patents, moral rights, semiconductor and circuit layout rights, trade, business, company and domain names, and other proprietary rights, trade secrets, know-how, technical data, confidential information and the right to have information kept confidential, or any rights to registration of such rights (including renewal), whether created before or after the date of this agreement.

    7 CHANGES TO YOUR BOOKINGS

    7.1 CANCELLATIONS

    (a) You are solely responsible for cancelling a Booking if you cannot attend a Pole Fitness Class.

    (b) All cancellation requests must be processed via the Addictive Pole Fitness App.

    (c) Cancellations for Bookings that occur less than 4 hours from the start time of a Pole Fitness Class will expend one (1) class pass from your membership allocation.

    7.2 ADDITIONAL CLASSES

    You may attend more than the allocated number of classes for your membership allocation by purchasing an “Additional class pass” via our Website.

    7.3 UNPAID CLASSES

    (a) For the purpose of this Clause 7.3 being “Absent” includes, but is not limited to:

    (i) being absent from a Pole Fitness Class that you have made a Booking for;

    (ii) failing to check into a Pole Fitness Class that you have made a Booking for;

    (iii) arriving more than 5 minutes late to a Pole Fitness Class that you have made a Booking for; and

    (iv) cancelling a Booking for a Pole Fitness Class less than 2 hours prior to the start time of a Pole Fitness Class.

    (b) Addictive Pole Fitness reserves the right to charge you for an Additional class pass if you:

    (i) attend a Pole Fitness Class without paying the relevant Fee;

    (ii) are Absent from a Pole Fitness Class.

    7.4 REFUNDS

    (a) Generally, we do not provide refunds if you change your mind about a Booking. However, we understand that life happens. If you think you’re entitled to a refund, please contact us via email explaining your circumstances and what Pole Fitness Classes you have booked, and we will assess your situation and determine whether you are entitled to a refund at our absolute discretion.

    (b) Nothing in this clause 7 is intended to limit or otherwise affect the operation of any of your rights which cannot be excluded under applicable law, including the Competition and Consumer Act 2010 (Cth).

    8 MEMBERSHIP ETIQUETTE

    By creating a Booking you also agree to the following policies mandated by Addictive Pole Fitness:

    (a) Studio Rules

    (b) Health Screen Form Policy

    (c) Social Media Policy

    (d) Term of Use

    (e) Privacy Policy

    (f) Minor Policy

    (g) Class Specific Policies

    9 PUBLISHING PHOTOS ONLINE OR ON SOCIAL MEDIA

    Subject to your agreement of non-disparagement of us and the Pole Fitness Classes, you may publish general information about what you have learnt from the Pole Fitness Classes, online or on social media (or both), provided such information is general in nature and does not cover any of the actual content or information covered in the Pole Fitness Classes, any sensitive information shared by other participants in a Pole Fitness Class, or any photos or information about other members without their express consent. We ask that you please provide accreditation to us by reference or hashtag if you make such a publication. We reserve the right to require you to remove any such publications or remove any accreditation to us.

    10 DATA SECURITY

    While we will use our best efforts to ensure that your information, data or other electronic materials (Data) that is being backed-up or stored as part of the Pole Fitness Classes will be stored securely, we will not be liable for any unauthorised use, destruction, loss, damage or alteration to the Data, including due to hacking, malware, ransomware, viruses, malicious computer code or other forms of interference.

    11 THIRD PARTY SERVICES, CONTENT, TERMS AND WEBSITES

    11.1 THIRD PARTY GOODS AND SERVICES

    (a) The Pole Fitness Classes may be powered by goods or services provided third parties (including third party platforms such as Mindbody) and therefore subject to the terms and conditions of those third parties. Your use of the Pole Fitness Classes is subject to any applicable third party terms and conditions and you agree to familiarise yourself with all applicable third party terms and conditions.

    (b) To the maximum extent permitted under applicable law and our agreements with any applicable third parties, we will not be liable for any acts or omissions of those third parties, including in relation to any fault or error of the Pole Fitness Classes or any issues experienced in Booking.

    11.2 THIRD PARTY CONTENT

    The Pole Fitness Classes may contain text, images, data and other content provided by a third party and displayed in the information provided through the Pole Fitness Classes (Third Party Content). We accept no responsibility for Third Party Content and make no representation, warranty or guarantee about the quality, suitability, accuracy, reliability, currency or completeness of Third Party Content.

    11.3 LINKS TO OTHER WEBSITES

    (a) The Pole Fitness Classes may contain links to other websites that are not our responsibility. We have no control over the content of any linked websites, and we are not responsible for that content.

    (b) Inclusion of any linked website on the Pole Fitness Classes does not imply our approval or endorsement of the linked website.

    12 SECURITY

    We do not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the Pole Fitness Classes. You should take your own precautions to ensure that the process that you employ for accessing the Pole Fitness Classes does not expose you to risk of viruses, malicious computer code or other forms of interference.

    13 REPORTING MISUSE

    If you become aware of misuse of the Pole Fitness Classes by any person, any errors in the material in the Pole Fitness Classes or any difficulty in accessing or using the Pole Fitness Classes, please contact us immediately using the contact details or form provided on our Website.

    14 SERVICE LIMITATIONS

    The Pole Fitness Classes is made available to you strictly on an ‘as is’ basis. Without limitation, you acknowledge and agree that we cannot and do not represent, warrant or guarantee that:

    (a) the Pole Fitness Classes will be free from errors or defects;

    (b) the Pole Fitness Classes will be accessible at all times;

    (c) information you receive or supply through the Pole Fitness Classes will be secure or confidential; or

    (d) any information provided through the Pole Fitness Classes is accurate or true.

    15 NOTICES

    (a) A notice or other communication to a party under these terms must be:

    (i) in writing and in English; and

    (ii) delivered to the other party via email, to the email address most regularly used by the parties to correspond regarding the subject matter of these terms as at the date of these terms (Email Address). The parties may update their Email Address by notice to the other party.

    (b) Unless the party sending the notice knows or reasonably ought to suspect that the email was not delivered to the other party’s Email Address, notice will be taken to be given:

    (i) 24 hours after the email was sent, unless that falls on a Saturday, Sunday or a public holiday in the state or territory whose laws govern this agreement, in which case the notice will be taken to be given on the next occurring business day in that state or territory; or

    (ii) when replied to by the other party,

    whichever is earlier.

    16 RISK

    (a) Participating in the Activities involves the potential for injury and the Member is participating in any Activities at their own risk with knowledge of the dangers involved, including but not limited to, physical injury, muscle and ligament strains, illness, bruising, falls, injury through equipment failure, injury through impact during pole fitness participation and death (together, the Risks).

    (b) You acknowledge that there will be times where you will be unsupervised by any Addictive Pole Fitness personnel and agree to accept any risks of loss, injury, damage or death arising out of your unsupervised use of the Services, unless there is reckless disregard or gross negligence on Addictive Pole Fitness’ behalf.

    (c) You will bear all risk of loss or destruction of, or damage to, any equipment and/or other property and/or people, including your child, arising out or contributed to by your participation in the Pole Fitness Classes.

    17 LIABILITY

    (a) To the maximum extent permitted by applicable law, we limit all liability to any person for loss or damage of any kind, however arising whether in contract, tort (including negligence), statute, equity, indemnity or otherwise, arising from or relating in any way to the Pole Fitness Classes, the Website, the Services these terms or any other goods or services provided by us provided by us to the value of the Fees (if any) paid for the Pole Fitness Classes. If no Fee has been paid, liability is excluded to the maximum extent permitted by applicable law.

    (b) All express or implied representations and warranties in relation to the Pole Fitness Classes, the Website, the Services these terms or any other goods or services provided by us are, to the maximum extent permitted by applicable law, excluded.

    (c) Nothing in these terms is intended to limit the operation of the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth) (ACL). Under the ACL, you may be entitled to certain remedies (like a refund or replacement) if there is a failure with the goods or services we provide.

    (d) (Indemnity) You indemnify us and our employees and agents in respect of all liability for loss, damage or injury which is or may be suffered by any person arising from your or your representatives’:

    (i) breach of any of these terms;

    (ii) use of the Pole Fitness Classes, the Website, the Services or any other goods or services provided by us; or

    (iii) use of any other goods or services provided by us.

    (e) (Consequential loss) To the maximum extent permitted by law, under no circumstances will we be liable for any incidental, special or consequential loss or damages, or damages for loss of data, business or business opportunity, goodwill, anticipated savings, profits or revenue arising under or in connection with the Pole Fitness Classes, the Website or the Services, these terms or any other goods or services provided by us (except to the extent this liability cannot be excluded under the Competition and Consumer Act 2010 (Cth)).

    18 DISPUTE RESOLUTION

    (a) A party claiming that a dispute has arisen under or in connection with this agreement must not commence court proceedings arising from or relating to the dispute, other than a claim for urgent interlocutory relief, unless that party has complied with the requirements of this clause.

    (b) A party that requires resolution of a dispute which arises under or in connection with this agreement must give the other party or parties to the dispute written notice containing reasonable details of the dispute and requiring its resolution under this clause.

    (c) Once the dispute notice has been given, each party to the dispute must then use its best efforts to resolve the dispute in good faith. If the dispute is not resolved within a period of 14 days (or such other period as agreed by the parties in writing) after the date of the notice, any party to the dispute may take legal proceedings to resolve the dispute.

    19 TERMINATION

    19.1 TERMINATING YOUR ACCOUNT

    Subject to clause 7, you may terminate your Account at any time (whether you have accessed the Pole Fitness Classes or not).

    19.2 TERMINATION FOR CONVENIENCE

    We may, in our sole discretion, terminate your Account and these terms for convenience at any time by providing 7 days’ written notice to you.

    19.3 TERMINATION FOR CAUSE

    Either party may immediately terminate these terms by written notice to the other party if:

    (a) the other party is in default or breach of these terms;

    (b) the other party is convicted, or any of the other party’s personnel are convicted, of a criminal offence involving fraud or dishonesty or an offence which, in the opinion of the other party, affects the other party’s obligations under these terms;

    (c) the other party or any of the other party’s personnel conducts themselves in a way tending to bring them or the other party into disrepute; or

    (d) the other party or any of the other party’s personnel has a conflict of interest that cannot be resolved to the satisfaction of the other party.

    19.4 EFFECT OF TERMINATION

    Upon termination of these terms:

    (a) your Account will be terminated, and you will no longer have access to your Account or the Pole Fitness Classes;

    (b) your data may be removed in accordance with their terms and conditions (accessible here);

    (c) any Fees paid are non-refundable (except in accordance with clause 4); and

    (d) you must immediately deliver to us all property belonging to us and materials comprising or containing any of Our IP (as defined in clause 6.2(a)) which is in your care, custody or control, and you must thereafter destroy any copies you have of such materials.

    19.5 SURVIVAL

    Any clause that by its nature would reasonably be expected to be performed after the termination or expiry of these terms will survive and be enforceable after such termination or expiry.

    20 GENERAL

    20.1 GOVERNING LAW AND JURISDICTION

    These terms is governed by the law applying in Queensland, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of Queensland, Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with these terms. Each party irrevocably waives any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum.

    20.2 WAIVER

    No party to these terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.

    20.3 SEVERANCE

    Any term of these terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of these terms is not limited or otherwise affected.

    20.4 JOINT AND SEVERAL LIABILITY

    An obligation or a liability assumed by, or a right conferred on, two or more persons binds or benefits them jointly and severally.

    20.5 ASSIGNMENT

    You cannot assign, novate or otherwise transfer any of its rights or obligations under these terms without the prior written consent of the other party. We can assign the rights or novate these terms in whole or part without your consent, on notice which may be communicated electronically on the website or by email.

    20.6 COSTS

    Except as otherwise provided in these terms, each party must pay its own costs and expenses in connection with negotiating, preparing, executing and performing these terms.

    20.7 ENTIRE AGREEMENT

    These terms embodies the entire agreement between the parties and supersedes any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of these terms.

    20.8 INTERPRETATION

    (a) (singular and plural) words in the singular includes the plural (and vice versa);

    (b) (gender) words indicating a gender includes the corresponding words of any other gender;

    (c) (defined terms) if a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;

    (d) (person) a reference to “person” or “you” includes an individual, the estate of an individual, a corporation, an authority, an association, consortium or joint venture (whether incorporated or unincorporated), a partnership, a trust and any other entity;

    (e) (party) a reference to a party includes that party’s executors, administrators, successors and permitted assigns, including persons taking by way of novation and, in the case of a trustee, includes any substituted or additional trustee;

    (f) (these terms) a reference to a party, clause, paragraph, schedule, exhibit, attachment or annexure is a reference to a party, clause, paragraph, schedule, exhibit, attachment or annexure to or of these terms, and a reference to these terms includes all schedules, exhibits, attachments and annexures to it;

    (g) (document) a reference to a document (including these terms) is to that document as varied, novated, ratified or replaced from time to time;

    (h) (headings) headings and words in bold type are for convenience only and do not affect interpretation;

    (i) (includes) the word “includes” and similar words in any form is not a word of limitation; and

    (j) (adverse interpretation) no provision of these terms will be interpreted adversely to a party because that party was responsible for the preparation of these terms or that provision.

    By signing these terms and conditions and purchasing this membership, you agree to be personally bound by these terms and conditions, whether for yourself or on behalf of a minor, if you are registering on behalf of a minor. By clicking "I accept" and purchasing this membership, you represent and warrant that you are at least 18 years old, and if you are registering on behalf of a minor, that you are their legal guardian.

    I/We hereby authorise Global Payments Australia 1 Pty Ltd ACN 601 396 543 (Direct Debit User ID number 342190, 342191, 428198) (referred to as “Ezidebit”) to make

    periodic debits on behalf of the Business (referred to as “the Business”) as indicated on the attached Direct Debit Request which incorporates this DDR Service Agreement.

    I/We acknowledge that Ezidebit is acting as a Direct Debit Agent for the Business and that Ezidebit does not provide any goods or services (other than the direct debit

    collection services) to me/us for the Business pursuant to the Direct Debit Request and has no express or implied liability in relation to the goods and services provided or to

    be provided by the Business or the terms and conditions of any agreement that I/We have with the Business.

    I/We acknowledge that the debit amount will be debited from my/our nominated card or bank account according to the terms and conditions of my/our agreement with

    the Business and the terms and conditions of the Direct Debit Request (and specifically the Debit Arrangement including the Fees/Charges in the Direct Debit Request).

    I/We acknowledge that the details of my/our nominated card or bank account should be verified (eg: against a recent card or bank statement) to ensure accuracy of the

    details provided and I/we will contact my/our financial institution if uncertain of the accuracy of these details.

    I/We acknowledge that is my/our responsibility to ensure that there are sufficient available/cleared funds in the nominated account by the due date to enable the direct

    debit to be honoured on the due date for the debit. Direct debits normally occur overnight, however transactions can take up to 3 banking business days depending on the

    financial institution. Accordingly, I/we acknowledge and agree that sufficient funds will remain in the nominated account until the debit amount has been debited from the

    account. If there are insufficient funds available, I/we agree that Ezidebit will not be responsible for any fees and charges that may be charged by either my/our or its

    financial institution.

    I/We acknowledge that there may be a delay in processing the debit if:

    1. A payment request is received by Ezidebit after Ezidebit’s usual cut off time, being 3:00pm Qld time, Monday to Friday;

    2. A payment request is received by Ezidebit on a day that is not a banking business day in Sydney, NSW and Melbourne, VIC; or

    3. There is a public or bank holiday on the day when the debit transaction is due to be processed or on any of the following days until the debit is processed.

    Any payment that falls due on any of the above will be processed on the next business day.

    I/We authorise Ezidebit to vary the amount of the payments from time to time upon receiving instructions from the Business of a variation provided for within my/our

    agreement with the Business or as may be agreed by me/us and the Business. I/We do not require Ezidebit to notify me/us of the variation to the debit amount.

    I/We acknowledge that Ezidebit is to provide at least 14 days' notice if it proposes to vary any of the terms and conditions of the Direct Debit Request (including this DDR

    Service Agreement) including varying the Debit Arrangement.

    I/We will contact the Business if I/we wish to alter or defer the Debit Arrangement.

    I/We acknowledge that any request by me/us to stop or cancel the Debit Arrangement will be directed to the Business.

    I/We acknowledge that any dispute regarding a debit will be directed to the Business and/or Ezidebit. If no resolution is forthcoming, I/we will contact my/our financial

    institution.

    I/We acknowledge that if a debit is returned by my/our financial institution as unpaid, a failed payment fee (as referred to in the Debit Arrangement) may be payable by me/

    us to Ezidebit. I/We will also be responsible for any fees and charges applied by my/our financial institution for each unsuccessful debit attempt together with any collection

    fees, including but not limited to any solicitor fees and/or collection agent fee as may be incurred by Ezidebit.

    I/We authorise Ezidebit to attempt to re-process any unsuccessful payments as advised by the Business.

    I/We acknowledge that certain fees and charges (including setup, variation, SMS or processing fees) may apply to the Direct Debit Request and may be payable to Ezidebit

    and agree to pay those fees and charges to Ezidebit.

    “Ezidebit” may appear as the merchant for a payment from my/our credit card (including a debit or charge card). I/We acknowledge and agree that Ezidebit will not be liable

    for any disputed transactions resulting from the supply or non supply of goods and/or services and that all disputes will be directed to the Business (as Ezidebit is acting

    only as a Direct Debit Agent for the Business). The Transaction Fee for a debit to a Credit Card calculated as a percentage may be subject to a minimum amount.

    I/We appoint Ezidebit as my/our agent for the control, management and protection of my/our personal information (relating to the Business and this Direct Debit Request)

    which is disclosed to Ezidebit. I/We irrevocably authorise Ezidebit to take all necessary action (which Ezidebit deems necessary) to protect and/or correct, if required, my/our

    personal information, including (but not limited to) correcting account numbers and providing such information to relevant third parties and otherwise disclosing or

    allowing access to my/our personal information to third parties in accordance with the Ezidebit Privacy Policy.

    Other than as provided in this Direct Debit Request or the Ezidebit Privacy Policy, Ezidebit will keep your personal information about your nominated account private and

    confidential unless this information is required to investigate a claim made relating to an alleged incorrect or wrongful debit, to be referred to a debt collection agency for

    the purposes of debt collection or as otherwise required or permitted by law. The Ezidebit Privacy Policy can be found at http://www.ezidebit.com.au/privacy-policy/

    I/We hereby irrevocably authorise, direct and instruct any third party who holds/stores my/our personal information (relating to the Business and this Direct Debit Request)

    to release and provide such information to Ezidebit.

    I/We authorise:

    1. Ezidebit to verify with my/our financial institution and/or correct, if necessary, details of my/our account; and

    2. My/our financial institution to release information allowing Ezidebit to verify my/our account details.

  • We understand that sometimes you need to take a break, or pole dancing is unfortunately no longer the right fit for you. As a small business, we ask members to make a small commitment of one (1) term at a time to help plan and offer great classes always. As per the Membership Terms & Conditions, the following applies to cancelling a membership.

    Recurring Membership

    A Recurring Membership has a term for a period commencing on the later of:

    A Recurring Membership Term will continue to renew for an additional 10 week period, unless otherwise cancelled

    The purchase of a Recurring Membership is non-refundable from the day of Booking.

    You may terminate a Recurring Membership at the conclusion of an active Recurring Membership Term by submitting to Addictive Pole Fitness, a completed membership termination form prescribed by us, prior to the commencement of a renewed 10-week Recurring Membership Term.

    If you terminate a Recurring Membership within 4 days of the conclusion of a Recurring Membership Term, you will automatically be charged a $40 late termination fee.

    You will be charged the full rate of Fees for a Recurring Membership Term if you cancel after the commencement of a renewed 10-week Recurring Membership Term and you will not be entitled to a refund.

    Members can only cancel by using the Cancellation Request Form.

    Pay In Full Membership

    The purchase of a Pay In Full Membership is non-refundable from the first day of the Pay In Full Term.

    Pay In Full Terms expire at the end of each term and you will need to purchase a new Pay In Full Membership by the end of the Pay In Full Term to continue as an active member.

    Addictive Pole Fitness will assume the member has cancelled a Pay In Full Membership if no membership is purchased by the end of the Pay In Full Term.

  • General

    Members may pause their membership for up to four (4) weeks each year.

    During a Contract Pause, members will pay a reduced suspension fee.

    Pay in full members may have the difference between the weekly fee and the suspension fee credits to their MindBody account. Addictive Pole Fitness will provide no cash refunds.

    Terms & Conditions

    All recurring memberships and pay in full pauses are granted at Addictive Pole Fitness's discretion.

    All requests must be received in writing, using the Contract Pause form only.

    Members must provide a minimum of four (4) business days' notice for the pause to take effect.

    There will be no backdating on applications. In this case, the pause will come into effect upon the next debit/week after Addictive Pole Fitness has approved.

    If the start date is not a Monday, the pause will take effect the following debit/week following.

    Memberships can be paused for a minimum of one (1) week and a maximum of four (4) weeks per year

    The pause may occur across two different terms.

    The member may not attend the studio during the pause period. If the member wishes to return within a pause period, the member must pay the balance of the fees for that week. For example, if the membership rate is $52 per week and the member has paid a $10 pause rate and wish to return during that week, they will need to pay $42. Please email underwood@addictivepolefitness.com to make this request.

    For the period after a contract pause, the member must have debits/weeks at the standard rate for the same period of the pause. Members cannot use a contract pause to reduce payments if they plan to cancel. For example, suppose a member was to apply for a 2-week pause. In that case, they will have a minimum of 2 debits at the normal price, or cancel at the end of term, whichever is equal to the pause period.

    Suppose the member cancels after a pause period. In that case, the equivalent amount will be debited from their account until this amount is recovered. Suppose the amount is not able to be recovered. In that case, Addictive Pole Fitness will undergo the failed payment policy outlined in the Membership Terms & Conditions.

    The member's responsibility is to catch up on content missed from the pause period. Instructors are not able to spend additional time on personal catch-ups. If additional instruction is required, members can book a private lesson.

  • Upgrading your membership can happen at any time during the term!

    All membership upgrade requests must be completed in writing using the relevant form, with a minimum of four (4) business days’ notice.

    When you upgrade your membership, you agree to the following:

    Addictive Pole Fitness will change all remaining direct debits on your current contract to the amount specified in New Membership drop-down window on the membership upgrade form. For example: if you are upgrading from a starter to addicted, you agree to pay the amount of the addicted membership for the rest of the current term (your current membership period).

    Suppose you do not submit a cancellation or downgrade form by the end of the term. In that case, the membership you are requesting to upgrade to now will roll over and be effective in the new term, as per the original membership terms and conditions.

    You give Addictive Pole Fitness permission to update my Ezidebit payments to reflect the amount of my new membership level.

    You understand that your upgrade will not take effect until your following direct debit.

  • Need to slow your pole journey down? Members can downgrade their membership at the end of each term.

    All membership upgrade requests must be completed in writing using the relevant form, with a minimum of four (4) business days’ notice, before the end of the term.

    When you downgrade your membership, you agree to the following:

    In the new term, Addictive Pole Fitness will change your contract to the amount specified in the New Membership drop-down window on the membership downgrade form. For example: if you are decreasing your membership from an addicted to starter, you agree to pay the amount of the starter membership for the new term.

    You give Addictive Pole Fitness permission to update my Ezidebit payments to reflect the amount of my new membership level.

    The downgrade will be effective until you submit an upgrade, cancellation or downgrade form.

  • Addictive Pole Fitness welcomes women or female-presenting individuals to participate in our studio pole dancing classes.

    Parental or guardian consent is required for all participants between 14 and 17. When completing a parental or guardian consent form, you are confirming the following:

    You provide consent for the minor to participate in classes at Addictive Pole Fitness.

    The minor is at least 14 years of age.

    You have completed a Health Screen Form on their behalf.

    You know that pole dancing is physically demanding, and specific risks are involved.

    You are aware that the minor may be exposed to adult themes whilst undertaking classes at Addictive Pole Fitness.

    Suppose the participant wishes to join Addictive Pole Fitness on a membership. In that case, memberships must be Pay In Full, or a parent or guardian will complete a Direct Debit Form in the studio on their behalf.

    We welcome and encourage parents/guardians to come into the studio to meet the team and see the space.

  • This Refund Policy (“Policy”) applies to the following purchases: any goods or services purchased through www.addictivepolefitness.com, MindBody Software, Addictive Pole Fitness App or in-person at Addictive Pole Fitness.

    General

    We offer refunds, repairs and replacements in accordance with the Australian Consumer Law and on the terms set out in this policy.

    Any benefits set out in this Policy may apply in addition to consumer’s rights under the Australian Consumer Law.

    Before purchasing from Addictive Pole Fitness, please read this Policy to understand your rights and what you can expect from us if you are unsatisfied with your goods or services.

    Australian Consumer Law

    Under the Australian Consumer Law:

    Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled

    To cancel your service contract with us; and

    To a refund for the unused portion or to compensation for its reduced value.

    You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and cancel the contract for the service and obtain a refund for any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

    We offer refunds, repairs and replacements in accordance with the Australian Consumer Law.

    The Australian Consumer Law provides a set of Consumer Guarantees which protect consumers when they buy products and services.

    If the Australian Consumer Law applies, then we cannot avoid the Consumer Guarantees that it provides. If there is any inconsistency between this Policy and Australian Consumer Law, the Australian Consumer Law will prevail.

    Further information about the Australian Consumer Law and these Consumer Guarantees are available from the website of the Australian Competition and Consumer Commission.

    If a product or service which you purchased from us has a major failure (as defined in the Australian Consumer Law), then you may be entitled to a replacement or refund. You may also be entitled to compensation for any reasonably foreseeable loss or damage resulting from that major failure.

    If a product or service which you purchased from us has a failure that does not amount to a major failure (as defined in the Australian Consumer Law) then you may still be entitled to have the goods repaired or replaced.

    Cancellation and Change of Mind

    We do not offer any refund if you change your mind or find the same product or service cheaper elsewhere.

    All services at Addictive Pole Fitness, are non-refundable or non-transferable.

    Products Damaged During Delivery

    In the event that the product you ordered has been damaged during delivery:

    Please contact us as soon as possible.

    Any damaged product must be returned in the condition in which it was received, together with any packaging and other items which you received with the damaged product.

    We will arrange to repair or collect the damaged product and replace it with an equivalent product or to refund it, provided that you have contacted us within fourteen (14) days from the date of receiving the product.

    Exceptions

    Notwithstanding the other provisions of this Policy, we may refuse to provide a repair, replacement or refund for a product or service purchased by you if:

    You misused the said product in a way which caused the problem.

    You knew or were made aware of the problem(s) with the product or service before you purchased it.

    You asked for a service to be done in a certain manner, or you asked for alterations to a product against our advice, or you were unclear about what you wanted.

    Any other exceptions that apply under the Australian Consumer Law.

    Shopping Costs for Returns

    In the event that a product you have purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we shall bear any costs of shipping the said product (the “Returned Product”) back to us, as well as any cost of shipping any replacement product to you.

    If the Returned Product can easily be shipped or returned, you are responsible for organising for the Returned Product to be returned to us. If the Returned Product is eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law) then we will reimburse you for the reasonable postage, shipping or transportation costs for the Returned Product.

    If the Returned Product is too large, too heavy, or otherwise too difficult to be removed and returned by you and is believed to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then we will organise for the postage, shipping transportation or collection of the Returned Product, at our cost.

    In the event that we organise and pay for the inspection, postage, shipping, transportation or collection of the Returned Product, and it turns out not to be eligible for a repair, replacement or refund under the terms of this Policy (including the Australian Consumer Law) then you will be required to pay the costs of any inspection, postage, shipping, transportation or collection of the Returned Product.

    Response Time

    We aim to process any requests for repayment, replacements or refund within two (2) business days of receipt.

    How to Return Products

    You can contact us, using the details at the end of this Policy to discuss a return.

    Unless otherwise defined, at our sole discretion, we shall pay all refunds in the same form as the original purchase or to the same account or credit card used to make the original purchase. Any fees associated with the initial purchase will be subtracted from the amount refunded.

    To be eligible for a refund, repair or replacement, you must provide proof of purchase.

    You may be required to provide government-issued identification to qualify for a refund, repair or replacement.

  • During your visit to the studio, it is a requirement that you do all that is reasonable to minimise the risk of harm to yourself and others. Ensure that you have read the rules below before engaging in any activity on the pole and the studio.

    Attending the studio

    Students are not permitted to attend the studio unless all payments and due fees are up to date.

    Team members reserve the right to refuse entry to any student they deem to be in breach of any studio rule. Leadership will support staff in their decision.

    We do have neighbours. If you are poling with us during the day, utilise street parking and pop a skirt or shorts over your booty shorts.

    Follow all reasonable directions given by studio team members.

    Each time you visit, check in to the studio using the iPad or the Addictive Pole Fitness app.

    If you are more than 5 minutes late for a series, drop-in or zoom class, you will not be able to attend the class. The late rule reduces injury opportunities, as the warm-up is almost over and disruptions it may cause to classes.

    Pop your bag in the allocated bag spot. Keep these off the studio floor where possible.

    Bring your towel- no towel, no train.

    Remove your rings before class; they can scratch and damage the pole and your rings.

    Always start your session by wiping down your pole with a towel and methylated spirits spray. Repeat this process at the end of your session – making sure to remove all chalk residue and other substances.

    Unless you are an APF instructor, you cannot teach anything to other students - you may be banned from the studio if caught.

    Place any items used back to their allocated spot. If you don't know where that is, please ask.

    Pick you your rubbish and place it in the bins around the studio.

    When attending the studio, nipples and genitalia are to be covered.

    Engagement in Activities

    Always warm up before your session.

    Please do not engage in dangerous activities beyond your limits.

    Do not engage in activity on the poles if you have been drinking alcohol or taking any medication/drugs that put your safety (or the safety of others) at risk.

    Please do not engage in activity or action within the studio that harms our business.

    Do not increase your risk of an incident by wearing products, such as moisturiser, fake tan, and some hair and makeup that come off onto the poles, making them slippery.

    Do not attempt any tricks in attire that is unsafe and suitable for that manoeuvre.

    When using the poles, be aware and mindful of those around you to avoid collisions.

    Only attempt moves that you have learned in class at Addictive Pole Fitness within your appropriate ability level. Unless discussed and approved by a team member.

    Spotting

    Always ensure that you have a 'spotter' if you are attempting a dangerous tricks that you have not yet safely and consistently 'mastered'.

    Suppose you are unsure whether the trick you are attempting is considered dangerous or whether you need a 'spotter'. In that case, you must first ask a team member (such as a receptionist, instructor or open practice supervisor) whether they think you need a 'spotter' for this trick.

    Suppose you have been doing a trick for a while and feel that you no longer need the 'spotter'. In that case, you must still check with a team member whether they agree that you can perform this move unassisted for the first time.

    Continually assess your risk before performing a trick, even if you are confident performing it. Strength and ability can fluctuate, and conditions (such as climatic variation and pole condition) can change. Your responsibility is to ensure you minimise the chances of an incident occurring because of your activity on the pole and the studio.

    A 'spotter' can be anyone in the studio if they understand the technical aspects of the trick being attempted and are physically capable of aiding you in and out of the trick safely if necessary. You must assess whether your spotter meets these requirements. Addictive Pole Fitness recommends that advanced students not rely on lower-level students for spotting unless they are sure that they meet the knowledge and capability requirements.

    Incidents

    If there is an incident, you are required to let a team member know. Even if you are in doubt if the incident is serious or not, you must advise a team member so that they can assess whether First Aid is required. An Incident Report might need to be completed.

    Our team are all First-Aid qualified. You must follow the directions of team members in case of an accident or incident that requires First Aid and follow all the instructions necessary for filling out an Incident Report.

    If you need to use the First Aid Kit, ensure a qualified person attends to your scenario.

    Advise a team member of any items removed from the First Aid box to purchase replacements.

    When your pole sister is down or struggling with a move, cheer louder for them. When they celebrate a win, celebrate with them. If they have a bad day, acknowledge and let them know you are there.

    Addictive Pole Fitness will not tolerate bullying, intimidation or negative talk or behaviours towards another member.

    Mobile Phones- Filming and taking photos of our progress is important and ENCOURAGED. Phones are allowed in class for these activities only. Please stay off phones while instructors are teaching and talking.

    Team Members

    Our instructors and team members love you! For most team members, it is their second job, and they love what they do. They spend countless hours thinking about new things to teach, new ways to make you hurt or amazing choreo. Please show respect to your instructors in class! Please:

    Be mindful of when they are demonstrating. Sometimes instructors can be upside down for a long time, trying to explain every element you need to achieve the trick. LISTEN. That is all they ask for your undivided attention at this time.

    Please pay attention to their recommendations and listen to their advice. If they are correcting your technique, there is a reason for it. They have trained for this. Trust in them.

    Don't compare them to one another. We love that our team is so diverse! They are never going to teach the same. They will bring their individual experiences to the class. Diversity is going to give you THE BEST experience. They are all unique, which makes the team here impressive.

    Our instructors may receive requests from members about that member’s specific circumstances or may provide pole dancing, conditioning, dance, or flexibility training information for educational purposes. They do not offer or provide professional medical advice, diagnosis, treatment, or rehabilitation and may refer the member to third-party resources. Any referrals to official bodies are not intended and should not be construed as an endorsement, promotion, or recommendation by Addictive Pole Fitness.

    Addictive Pole Fitness has general parking rules for visitors to our studio. These rules are in place to help ensure our neighbouring businesses have access to their buildings and car parks at reasonable times. Addictive Pole Fitness, generally speaking, only has access to two (2) car parks at all times, however outside of studio hours, there is the option to utilise neighbouring business's car parks. Parking rules can change depending on the time or day of the week.

    Weekdays before 5 pm

    Street parking only on Elayne Street (or other neighbouring streets)

    During this time, Addictive Pole Fitness only has access to two (2) car parks, therefore we ask visitors not to park onsite and to utilise street parking.

    Weekdays after 5 pm

    Onsite and street parking are available.

    During this time do not park in front of other businesses or their garage doors, as they may need access to them after hours.

    Weekends

    Onsite parking and street parking are available.

    During this time do not park in front of other businesses, their garage doors or in the disabled parking located next to Able Scales, as these businesses may need to access their premises during these times. Please do not park on the far side of Elayne Street, see the picture below.

    General Notes

    Please always lock your doors and leave valuables out of sight.

    The area is approved for heavy vehicle parking, if there is a truck trailer parked on the street, please leave enough space for a truck to access the trailer.

    Addictive Pole Fitness only has two (2) designated car parking spaces, these are the 4th and 5th spots from the driveway. They are not labelled, so please consider our neighbouring businesses when visiting the studio.

  • Addictive Pole Fitness is a safe space for many people. During your visit to the studio, it is a requirement that you respect privacy and intellectual property. Before sharing your pole journey on any social media platform, please consider the following.

    Intellectual Property

    The Addictive Pole Fitness level routines and choreography are copyrighted and cannot be shared in full. Any video recording may be used for personal use only (like remembering all that choreo).

    Instructor Drop-In routines are the intellectual property of the instructor who created them. You may post with their permission. If you do share, don't forget to credit the instructor.

    Privacy

    Privacy laws apply to all our members and are in place for their protection. Do not put members in a situation that could put their jobs, personal life, or themselves at risk by being identifiable in video or video grabs you post. Please ask everyone around you for permission before filming.

    Ensure you have permission before posting any photos on social media. Alternatively, you can blur/block other members, so they cannot be identified (including faces and visible tattoos).

    If students breach this policy, Addictive Pole Fitness may terminate their membership.

  • Most classes at Addictive Pole Fitness are conducted in a group fitness environment.

    It is your responsibility to ensure that you inform the instructor, at the start of every class, about any condition or injury requiring program modifications to suit your individual needs.

    You must also inform the instructor if you feel any discomfort or acquire any injury during the class so that the program can be suitably modified or first aid action is taken where required.

    The team at Addictive Pole Fitness are not able to provide you with personal medical advice. They can only modify the program based on the information you give them in each class.

    When you complete a health screen form, you are agreeing to the following:

    By completing this Liability Release, I acknowledge that I must assess my own fitness level, ability to exercise and risk to my health by participating in any activity at Addictive Pole Fitness (the studio) or online.

    I am aware that there is some risk involved with any exercise. My use of and participation in the studio or online, facilities and equipment may include some risk.

    I acknowledge that any physical conditions I may have, whether I am aware or not, or which I may or may not have disclosed to "Addictive Pole Fitness", may be aggravated, or worsened by participation.

    I agree to inform staff at "Addictive Pole Fitness" of all current injuries and illnesses and accept any modifications the instructor may make to the program to accommodate these conditions.

    I agree to accept reasonable first aid advice and attention from the instructor and fulfil any requirements for incident reports in the case of an injury or incident during my time in the studio or online.

    I participate in any classes acknowledging that my participation in this activity is not without risk or danger.

    I hereby assume all responsibility for the dangers in undertaking any activities in the studio or online and hereby release and forever discharge Cali B Pty Ltd atft Cali B Trust trading as "Addictive Pole Fitness" and its employees, contractors or agents from all actions, suites, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses ("Claims") howsoever arising, that I may have or may have had, arising from or in connection with my involvement in any activities in the studio or online or my attendance at the studio or online;

    I hereby indemnify and shall continue to indemnify Cali B Pty Ltd atft Cali B Trust trading as "Addictive Pole Fitness" or and its employees, contractors or agents in respect of any Claims arising, as a result of or in connection with, whether caused or contributed to (either directly or indirectly) by any act of negligence or omission on my part.

    I agree to abide by Addictive Pole Fitness Studio and Zoom Rules located on the Addictive Pole Fitness website and will do all that I can to minimise the risk of harm to myself and/or others during my visit to Addictive Pole Fitness. I have read and agree to all of the terms and conditions outlined above.

    REGISTRATION PROCESS

    When you become a member of the Website, Software or express your interest, you will be asked to complete an online form to submit different information about you. Such information may include:

    The Website, Software or Facebook Group allows you to post and submit content, including photographs and images, level of capability in pole dance, fitness levels, flexibility or conditioning levels, dance ability. You do not need to post or submit any content. However, if you do, we collect the information that you submit.

    We also collect any other information you provide to us (whether orally, by mail, email, or online).

    COMPETITIONS AND PROMOTIONS

    From time to time, we may organise and run various competitions and promotions for users of the Website or Software. As part of these competitions and promotions, we may ask you to submit other personal information about yourself.

    You do not have to provide us with this information. However, this means that you may not be eligible to enter some competitions nor able to receive tailored information specific to your needs.

    GEO-LOCATION DATA

    We may ask you to track location-based information from your mobile device while downloading or using our Mobile Apps or Services to tailor your experience. If you don't grant permission, we do not collect any location-based data.

    TRACKING OF USER EXPERIENCE

    We use Google Analytics Advertising products: Remarketing with Google Analytics and Analytics Demographics and Interest Reporting.   • EFTPOS Policy

    All EFTPOS transactions, completed in person or over the phone, will incur a surcharge fee. The surcharge will be displayed after your card has been tapped, inserted or swiped, as the amount charged will be depended on the card type presented.

    As per the ACCC rules, the surcharge will never exceed the amount charged to Addictive Pole Fitness by the merchant provider. Surcharge amounts are displayed in the studio and will be communicated to you for over-the-phone purchases.

    Cancelling Classes

    The process below is relevant to all class types

    Four (4) hours before the class start time

    If you cancel within four (4) hours of the class, your class pass will be forfeited.

    If you are absent from the class, your class pass with be forfeited.

    It is encouraged to cancel as early as possible to provide students on the waitlist an opportunity to book into the class.

    It is the responsibility of the member to manage their class schedule.

  • It takes time to build strength and technique for pole tricks, and we have open practice rules to protect you and the studio. We take safety seriously. Any student caught breaking these rules may be banned from Open Practice or asked to leave the studio if they continue to break the rules. If you would like to be assessed to go up to a higher level, please ask us in reception, and we will book an appointment with you. If you want to learn tricks, book a private lesson with an instructor and tell them your wish list.

    Rule 1: Never teach another student of a lower level anything at all! No tips, no suggestions, no advice! If a student needs help, please ask an employed instructor.

    Rule 2: Students are never permitted to teach another student tricks- even students of the same level.

    Rule 3: You must only practice tricks you have learned in class here. If you want to learn a trick you have seen a picture or video of, please ask an instructor or do so at home. Just because it is on YouTube doesn’t necessarily mean it is described or performed correctly. Also, you may not have the strength or skill set to try it just yet.

    We want to keep each of you safe in our studio; therefore, these rules exist. Please keep them in mind when enrolling in open practice.

  • For all private lesson bookings or cancellations, we use the MindBody software. You can manage your private lessons using the following platforms:

    If the instructor you wish to have a private lesson with is unavailable, please email underwood@addictivepolefitness.com.

    Payment is required at the time of booking.

    Please enter the promo code on the payment screen to receive the member discount. Refer to the private Facebook community for the promo code.

    Cancellations or changes to Private Lessons must be completed more the 24 hours prior. All monies paid will be forfeited if cancellations or changes occur within 24 hours.

    If a Private Lesson is booked for a group of 2 or 3 people, and someone cancels their booking, the pricing for the lesson will change to the applicable rate. For example, if a booking for two (2) people and one person changes their mind; the remaining person will need to pay the 1:1 rate.

  • Participating in Zoom classes is a great way to attend drop-in classes from home. When you sign up for a Zoom class, you agree to the following:

    Your camera will remain on for the entire class; this allows us to view your technique still and help correct it as required.

    Where possible, you will remain muted just to reduce competing background noise. Please make sure you do unmute yourself if you have questions.

    Please do not use the chat function; the instructors will not reply.

    If you are joining us in the studio and the class is being streamed:

    Please do not talk when the instructor is giving directions or talking. It is hard for students tuning in from home to hear.

    Zoom Access Details

    The link and details for your Zoom Class can be located in the Booking Confirmation email.

    If you do not receive this email, please ensure your preferences for email communication are turned on or contact us on 0477 046 046 or underwood@addictivepolefitness.com at least 10 minutes prior to the class start time.

  • The mum's and bub's class is perfect for our ladies who have just had a baby or have little ones at home. This class has an instructor who knows what your body has been through and has the tools to help you get back into pole fitness.

    We understand how hard it can be to get back into fitness with having our little one needing you around. We have created this inclusive class for you and your bundle of joy to come to and relate to others who might be having similar experiences.

    IMPORTANT NOTES:

    Go at your pace in this class - encouraged to take regular breaks as needed.

    Share any advice you have received from your physio/GP about limitations with your instructor so that they can keep this in mind.

    If you need to take a break to care for your baby, stay and watch the class from nearby

    Your bub must either be not crawling in a pram or playpen. This is to ensure they cannot get to the area where you will be poling.

    BY BOOKING THIS CLASS YOU...

    Assume all risks relating to participation in our Mum's and Bub's Class

    Understand that physical activity entailed in class may cause or aggravate a physical injury or medical condition

    You are responsible for consulting with your healthcare practitioner before attending and getting approval

    Represents that they are physically fit and have no medical condition or injury that would prevent full participation in class

    Voluntarily waives any claim against Addictive Pole Fitness-Underwood for any damages, injury or condition sustained as a result of entering the premises, or being on-premises, or participating in the program;

    Are responsible for informing us of any medical conditions, injuries, or surgeries before taking the class and will inform your studio of any changes to this

    Has no claim against Addictive Pole Fitness if you are refused participation

    Is aware you are responsible for personal adjustment and that ligaments remain soft from 4-6 months after birth and longer if breastfeeding, and you must care not to overstretch

    Will rest when needed and not do inappropriate exercises or poses for their body.

    Holds full responsibility for yourself and your baby

  • Level assessments are required for all new students who have previous pole dancing experience and would like to start their journey, at Addictive Pole Fitness, in a series level class higher than Beginner 1 (Beginner 2-Elite). In a 30-minute private lesson, the instructor will help potential students find the right level in the Addictive Pole Fitness curriculum. This is a really important step for experienced pole dancers, as all studios have different curriculums and if not assessed, students may be at risk of injury. No new tricks will be taught during this session, as level assessments are designed to see what the student can achieve confidently.

    The Addictive Pole Fitness Curriculum does have a strong focus on technique and completion of tricks on both sides. At the end of an assessment, the instructor will advise which series level class the student is most suited to.

    If a student has previous experience and would like to join Addictive Pole Fitness, but does not want to attend series-level classes, no assessment is required.

    Payment is required at the time of booking. If you have already purchased a membership with Addictive Pole Fitness, the level assessment is free, within the first month.

    Cancellations or changes to level assessment must be completed more the 48 hours prior. All monies paid will be forfeited if cancellations or changes occur within 48 hours.

    Payment is required at the time of booking for Workshops.

    Workshops are refundable up until two (2) weeks before the scheduled event and can be transferred to another student within two (2) weeks of the event.

  • Pole Parties are a great way to celebrate birthdays, hens’ nights, and so much more. When booking a pole party at Addictive Pole Fitness, you are booking an experience that we guarantee you will not forget.

    Packages:

    PACKAGE 1 $350

    The minimum spends $350, which covers 10 guests. Additional guests $35 each.

    Includes: 1.5-hour party, tricks and dance taught, gift for the star of the party, share platter, a glass of bubbles, and non-alcoholic drinks.

    PACKAGE 2. $300

    The minimum spends $300, which covers 10 guests. Additional guests $30 each.

    Includes: 1.5-hour party. Tricks and choreo will be taught.

    PACKAGE 3 $168

    The minimum spends $168, which covers 6 guests. Additional guests $28 each.

    Includes: 1-hour party. Either tricks or choreo is taught.

    Available Days

    You can book your pole party on a Friday evening after 8 pm or Saturday and Sunday afternoons/evenings.

    Bookings

    Booking requests can be made by completing the Pole Party Booking request form. Please provide as much information as possible when completing the request form.

    Addictive Pole Fitness will be in contract within one (1) business day to confirm availability. A deposit of the minimum spend for your package is required to confirm your booking.

    You do not need exact numbers to book. Final numbers are required four (4) business days before the booking, and the final payment is to be made 48 hours before the pole party. This can be done over the phone.

    Cancellations

    If you cancel two (2) weeks or more before your event, you will receive a refund, minus a $100 Cancellation Fee. Addictive Pole Fitness will not refund any cancellations within two (2) weeks of your event.

  • Studio Hire is available outside of timetabled hours. When hiring the Addictive Pole Fitness Studio, you will have full access to 35 brass poles of differing diameters and heights, across three (3) pole rooms. This is perfect for competition practice, photoshoots or pole jams.

    Studio Hire is only available outside of timetabled hours.

    Studio Hire rate is an hourly rate.

    Price does not include clean up costs. Participants are responsible for ensuring the studio is in the same condition as when they arrived.

    Anyone who intends on using the poles during studio hire must have prior pole dancing experience and sign a waiver, if not a current member of Addictive Pole Fitness.

    Participants are not allowed to teach or instruct during their studio hire unless they have the correct qualifications to do so and this must be approved prior to hiring.

    No alcohol is to be consumed on-premises.

    Participants may be personally liable for any damages that occur during their hire.
